Agreement to Terms

These Terms and Conditions ("Terms," "Terms and Conditions") constitute a legally binding agreement between you and Manakeesh Hub ("we," "our," "us") governing your access to and use of our website, mobile applications, and services, including dining at our restaurant, placing orders, making reservations, and participating in our loyalty programs.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

Definitions

• "Services" refers to all products, services, content, features, and functionality offered by Manakeesh Hub
• "User," "You," "Your" refers to any individual who accesses or uses our Services
• "Website" refers to manakeeshhub.com and any related domains
• "Restaurant" refers to our physical dining establishment in Mysore
• "Order" refers to any purchase of food, beverages, or services from us

Use of Services

Eligibility

By using our Services, you represent and warrant that:

• You are at least 18 years of age or have parental/guardian consent
• You have the legal capacity to enter into a binding contract
• You will comply with all applicable laws and regulations
• All information you provide is accurate, current, and complete

Prohibited Activities

You agree not to:

• Use our Services for any illegal or unauthorized purpose
• Interfere with or disrupt our Services or servers
• Attempt to gain unauthorized access to any part of our systems
• Use automated systems or software to extract data from our website
• Impersonate any person or entity or misrepresent your affiliation
• Transmit any viruses, malware, or harmful code
• Engage in fraudulent activities or make false reservations
• Harass, abuse, or harm other users or our staff

Reservations and Orders

Reservations

• Reservations are subject to availability and confirmation
• We reserve the right to cancel reservations in case of emergencies or unforeseen circumstances
• Please arrive within 15 minutes of your reservation time. We may release your table if you are more than 15 minutes late
• For reservations of 8 or more guests, we may require a deposit or advance payment
• Cancellations should be made at least 2 hours in advance for standard reservations and 24 hours in advance for large groups

Orders and Payments

• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes
• We accept cash, credit/debit cards, UPI, and other payment methods as displayed
• For online orders, full payment is required at the time of ordering
• In the restaurant, payment is due upon presentation of the bill
• We reserve the right to refuse service or cancel orders if payment cannot be processed

Delivery and Takeaway

• Delivery is available within specified areas of Mysore
• Delivery times are estimates and may vary based on traffic and weather conditions
• Minimum order values may apply for delivery
• Please inspect your order upon receipt. Claims for missing or incorrect items must be made immediately
• Takeaway orders must be collected within the specified timeframe

Cancellation and Refund Policy

Restaurant Reservations

• Standard reservations: Cancel at least 2 hours in advance for full refund of any deposit
• Large group reservations (8+ guests): Cancel at least 24 hours in advance
• Late cancellations or no-shows may result in forfeiture of deposits

Online Orders

• Orders can be cancelled within 5 minutes of placement for full refund
• Once food preparation has begun, cancellations are not permitted
• Refunds for cancelled orders will be processed within 5-7 business days
• Refund method will be the same as the original payment method

Food Quality Issues

If you are not satisfied with the quality of your food:

• In-restaurant: Please notify your server immediately. We will replace the item or provide a refund
• Delivery: Contact us within 30 minutes of delivery with photographic evidence. We will offer a replacement or refund
• Complaints made after consumption may not be eligible for refund

Intellectual Property

All content on our website and related materials, including but not limited to text, graphics, logos, images, recipes, and software, is the property of Manakeesh Hub or our licensors and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, reproduce, distribute, or create derivative works from our content without written permission
• Use our trademarks, logos, or branding without authorization
• Remove any copyright or proprietary notices from our materials
• Use our content for commercial purposes without a license

User Content

By submitting reviews, photos, comments, or other content to us:

• You grant us a non-exclusive, royalty-free, perpetual license to use, display, and distribute your content
• You represent that you own or have the right to submit the content
• Your content does not violate any third-party rights or applicable laws
• We reserve the right to remove any content at our discretion

Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you consent to our data practices as described in the Privacy Policy.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that our services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information on our website
• Warranties that any defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MANAKEESH HUB AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruptions or website downtime
• Personal injury or property damage (except where caused by our gross negligence or willful misconduct)
• Any damages arising from food allergies or dietary restrictions not communicated to us
• Third-party conduct or content

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR INR 10,000, WHICHEVER IS LESS.

Indemnification

You agree to indemnify, defend, and hold harmless Manakeesh Hub and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your conduct in connection with our Services

Food Safety and Allergies

• We prepare food in a kitchen that handles common allergens including nuts, dairy, gluten, and shellfish
• Cross-contamination may occur despite our best efforts
• It is your responsibility to inform us of any food allergies or dietary restrictions
• While we take precautions, we cannot guarantee allergen-free preparation
• We reserve the right to refuse service if we cannot safely accommodate severe allergies

Alcohol Service

• Alcoholic beverages are served only to individuals aged 21 and above
• Valid government-issued photo ID is required
• We reserve the right to refuse alcohol service to intoxicated individuals
• Drunk and disorderly conduct will result in immediate removal from the premises
• Please drink responsibly. Do not drink and drive

Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activities
• Harassment or abusive behavior toward our staff or other customers
• Non-payment for services rendered
• Any other conduct we deem inappropriate

Upon termination, your right to use our Services will immediately cease.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website with a revised effective date. Your continued use of our Services after such changes constitutes acceptance of the new Terms.

It is your responsibility to review these Terms periodically for changes.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Mysore, Karnataka, India.

Dispute Resolution

In the event of any dispute:

1. Negotiation: We encourage you to contact us directly to resolve any issues informally
2. Mediation: If negotiation fails, parties agree to attempt mediation in Mysore
3. Arbitration: If mediation fails, disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996
4. Litigation: If arbitration fails or is not applicable, disputes shall be resolved in the courts of Mysore

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. No waiver shall be effective unless in writing and signed by an authorized representative of Manakeesh Hub.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on our Services, constitute the entire agreement between you and Manakeesh Hub regarding our Services, superseding any prior agreements, whether written or oral.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, acts of God, or pandemics
• Government restrictions or lockdowns
• War, terrorism, or civil unrest
• Power outages or technical failures
• Labor disputes or strikes
• Shortage of supplies or ingredients
